Challenge
Disputed Termination
A manufacturing SME in Penang carried out a retrenchment exercise affecting twelve employees. Several affected employees disputed the basis for their selection and the calculation of their entitlements under the Employment Act.
Approach
What We Did
We reviewed the employer's documentation, confirmed the procedural steps taken, and advised on statutory entitlements. Where the calculation methodology had gaps, we recommended corrections. We prepared representations and facilitated dialogue between the parties to reach a settlement without Industrial Court proceedings.
Outcome
Result
All twelve matters were resolved through negotiated settlement within six weeks. The employer avoided tribunal proceedings and the employees received the entitlements they were owed. Both parties confirmed they were satisfied with the process.
Challenge
Brand Registration Before Launch
A food and beverage company approaching a regional launch had been operating under a trade name for three years without formal trademark registration. A review of the market showed a potentially conflicting registration already filed by another party.
Approach
What We Did
We conducted a clearance search across relevant classes, assessed the conflict risk with existing registrations, and identified a modified filing strategy that distinguished the client's mark while preserving their commercial intent. Filings were submitted to MyIPO in two classes relevant to their business.
Outcome
Result
Both filings were accepted and entered examination phase without objection. The client proceeded with their regional launch with formal trademark protection in place. The modified filing strategy avoided the conflict that the original approach would have created.
Challenge
Compliance Audit for Foreign Workforce
A logistics company employing fourteen foreign nationals underwent an internal review and identified inconsistencies in their pass documentation — including two employees whose passes had lapsed without renewal. The company needed to regularise its position with the Immigration Department.
Approach
What We Did
We conducted a full documentation audit, identified the gaps and their implications, and prepared a regularisation plan. For the two lapsed passes, we managed the application process and ensured the company's voluntary disclosure was presented to the Department in a manner that minimised exposure. We then drafted an internal compliance checklist for ongoing management.
Outcome
Result
All documentation was regularised within ten weeks. The Immigration Department accepted the voluntary disclosure. The company now operates with a structured internal process for tracking and renewing passes, and has not had a recurrence of compliance gaps in the period since.
